The ‘Regulatory Reform (fire safety) Order 2005’

The above order came into effect October 2006. This brings together almost all the previous fire legislation and regulations into one place and will be enforced by the local Fire and Rescue service.

Who is affected by this change?

The main effect this will have is that the only premises that are exempt are single private dwellings.

What do I have to do to comply?

Every premise will require a ‘responsible person’ to carry out a Fire Risk Assessment.

There will no longer be fire certificates or legislation that depends on the type of occupancy within a premise or the number of people who work there.

Who is responsible for compliance?

 The ‘responsible person’ will be the employer (in relation to a workplace), or the person who has control of the premises in connection with carrying out trade, business or other undertaking, or the owner in the absence of the former.

There will be more emphasis on the training of staff in regards to actions to take in the event of fire.


Who can carry out your fire risk assessment?

Anyone who is deemed to be competent can carry the assessment but in the light of recent cases and prosecutions of the “responsible person” and/or the assessor that was employed it makes sense to employ a professional.
